These Terms of Service ("Terms") govern your access to and use of WaterPos, a Point-of-Sale platform for water
vending businesses ("the Service"), operated by WaterPos ("we", "us", or "our"). By creating an account or using
the Service, you agree to be bound by these Terms.
1 Acceptance of Terms
By accessing or using WaterPos, you confirm that you:
Are at least 18 years of age
Are legally authorised to operate the water vending business you register on the platform
Have read, understood, and agree to be bound by these Terms
Agree to our Privacy Policy, which is incorporated
into these Terms by reference
If you do not agree to these Terms, you must not use the Service.
2 Description of Service
WaterPos provides a cloud-based Point-of-Sale system designed for water vending businesses. The Service
includes:
Sales recording and order management
Water meter reading tracking
Customer and receivables management
Inventory and stock management
Business reporting (daily, weekly, monthly)
M-Pesa payment integration and reconciliation
Multi-store management with role-based user access
SMS and email notifications for business events
The Service is built on the Internet Computer blockchain infrastructure and is delivered
entirely through a web browser. No desktop installation or proprietary hardware is required.
3 Account Registration
To use WaterPos, you must register an account by providing a valid email address and phone number. You agree
to:
Provide accurate, current, and complete registration information
Keep your contact details up to date (required for OTP delivery)
Maintain the security of your login session and device
Notify us immediately if you suspect unauthorised access to your account
Accept responsibility for all activity that occurs under your account
Accounts are personal and non-transferable. You may not share login credentials or allow others to access your
account except through the designated store user invitation feature.
4 Subscription and Payment
Access to WaterPos is provided on a subscription basis. By activating a store subscription, you agree to the
following:
Billing
Subscriptions are billed monthly, per store
Payment is made via M-Pesa Paybill as displayed in the application
Subscriptions are activated upon receipt of a valid M-Pesa payment
Renewal and Expiry
Subscriptions do not auto-renew; you must manually make a payment each period
You will receive SMS and email reminders 3 days before your subscription expires
Access to your store is suspended upon subscription expiry until renewed
Your data is retained during the suspension period
Refunds
Subscription payments are generally non-refundable
In cases of service unavailability directly attributable to us, we will assess refund requests on a
case-by-case basis
You agree to use the Service only for lawful purposes related to managing your water vending business. You must
not:
Use the Service to conduct fraudulent transactions or misrepresent sales data
Attempt to gain unauthorised access to other users' stores or data
Use automated tools to scrape, stress-test, or disrupt the Service
Register false or misleading customer or business information
Resell or sublicense access to the Service without our written consent
Use the Service in a manner that violates any applicable Kenyan law or regulation
Violation of acceptable use policies may result in immediate suspension or termination of your account without
refund.
6 Your Data and Content
You retain ownership of all business data you enter into WaterPos, including sales records, customer
information, and financial data ("Your Content").
By using the Service, you grant us a limited, non-exclusive licence to store, process, and display Your Content
solely for the purpose of providing the Service to you.
You are responsible for:
The accuracy and legality of the data you enter
Obtaining any necessary consents from your customers before adding their personal data to the system
Complying with Kenya's Data Protection Act, 2019 with respect to any personal data you process
7 M-Pesa Integration
The M-Pesa integration feature is subject to the terms and conditions of Safaricom and the M-Pesa service. By
enabling M-Pesa integration for your store:
You authorise WaterPos to receive C2B payment callback notifications from Safaricom for your registered
shortcode
You acknowledge that WaterPos acts as a reconciliation tool and is not a licensed payment processor
You remain responsible for any disputes with your customers regarding M-Pesa transactions
You agree that WaterPos is not liable for delays, failures, or errors in M-Pesa payment processing
attributable to Safaricom
8 Service Availability
We strive to maintain high availability of the Service. However:
The Service is provided on an "as is" and "as available" basis
Availability is subject to the uptime of the Internet Computer network, which is outside our direct control
We do not guarantee uninterrupted or error-free access
Scheduled maintenance will be communicated in advance where possible
We will use reasonable efforts to resolve any outages or defects promptly.
9 Intellectual Property
All intellectual property rights in the WaterPos application, including its source code, design, trademarks,
and documentation, are owned by or licensed to WaterPos.
You may not copy, modify, distribute, or create derivative works of the Service or any part of it without our
prior written consent.
Nothing in these Terms transfers any intellectual property rights to you. The licence granted to you is limited
to using the Service as described herein.
10 Limitation of Liability
To the maximum extent permitted by applicable law:
WaterPos shall not be liable for any indirect, incidental, special, consequential, or punitive damages
arising from your use of the Service
Our total cumulative liability for any claim arising from these Terms shall not exceed the total
subscription fees you paid in the 3 months preceding the claim
We are not liable for loss of business data caused by factors outside our control, including Internet
Computer network failures
WaterPos is a business management tool. You are responsible for maintaining your own business records and
ensuring the accuracy of data entered into the system. Do not rely solely on WaterPos for statutory accounting
or tax compliance without independent verification.
11 Termination
By you: You may stop using the Service at any time. To request deletion of your account and
data, contact us at info@waterpos.app.
By us: We may suspend or terminate your account if you:
Violate these Terms or our Acceptable Use policy
Provide false information during registration
Engage in conduct that we reasonably believe poses a risk to other users or the integrity of the Service
Upon termination, your right to access the Service ceases immediately. We will retain your data for 30 days
after termination before permanent deletion, during which you may request an export.
12 Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of
Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the
courts of Kenya.
13 Changes to Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this
page. For material changes, we will notify store owners via email at least 14 days before the changes take
effect.
Continued use of the Service after the effective date of updated Terms constitutes your acceptance of the
changes. If you do not agree to the updated Terms, you must stop using the Service.
